Sec. 1114. Schoolwide programs

Section 1114 ( 20 U.S.C. 6314 ) is amended— in subsection (a)— in paragraph (1), by adding at the end the following: Funds under this part may be used to support evidence-based activities that address needs identified through the comprehensive needs assessment under subsection (b)(1)(A) and consistent with the schoolwide program. ; in paragraph (2)— in subparagraph (A)(ii), by striking provide and all that follows through the period and inserting identify particular services as supplemental. ; and by striking subparagraph
(B)and inserting the following: A local educational agency serving a school participating in a schoolwide program shall use funds available to carry out this section only to supplement the aggregate amount of funds that would, in the absence of funds under this part, be made available from State and local sources for the school, including funds needed to provide services that are required by law for children with disabilities and children who are English learners. To demonstrate compliance with clause (i), a local educational agency shall demonstrate that the methodology it uses to allocate State and local funds to each school receiving funds under this part ensures the school receives all of the State and local funds the school would otherwise receive if it were not receiving funds under this part. Section 1120A(b) shall not apply to schools operating schoolwide programs under this section. ; in paragraph (3)(B)— by inserting or after civil rights, ; and by striking , services to private school children, maintenance of effort, comparability of services, uses of Federal funds to supplement, not supplant non-Federal funds, or the distribution of funds to State educational agencies or local educational agencies ; and by striking paragraph
(4)and inserting the following: A school may carry out a schoolwide program under this subsection through an external provider if the school demonstrates, in the plan required under subsection (b)(2), that the external provider has expertise in using strategies and programs that are based on scientifically valid research to improve teaching, learning, and schools. ; in subsection (b)— in paragraph (1)— in subparagraph (A)— by striking section 1309(2) and inserting section 1312 ; and by striking section 1111(b)(1) and inserting section 1111(a)(1) ; and in subparagraph (B)— in clause (i), by striking to meet the State's proficient and advanced levels of student academic achievement described in section 1111(b)(1)(D) and inserting to be proficient or advanced students, as described in section 1111(a)(3)(B)(ii)(I) ; in clause (ii), by striking scientifically based research and inserting scientifically valid research ; and in clause (iii)— in subclause (I)— in item (aa), by striking pupil services and inserting specialized instructional support services ; in item (bb), by striking and after the semicolon; in item (cc), by striking vocational and technical education programs; and and inserting career and technical education programs; ; and by adding at the end the following: implementation of schoolwide positive behavioral interventions and supports, including through coordination with activities carried out under the Individuals with Disabilities Education Act, in order to improve academic outcomes for students and reduce the need for suspensions, expulsions, and other actions that remove students from instruction; and implementation of early intervening services, including through coordination with early intervening services carried out under the Individuals with Disabilities Education Act; ; and in subclause (II), by striking and after the semicolon; and by adding at the end the following: a multi-tier system of supports and positive behavioral interventions and supports; and support for programs, activities, courses, and professional development in the core academic subjects that are targeted toward assisting children described in subclause
(I)in meeting the academic content and student academic achievement standards described in section 1111(a)(1); and ; in subparagraph (C), by inserting and highly rated after qualified ; by striking subparagraphs
(D)and (F); by redesignating subparagraphs (E), (G), (H), (I), and (J), as subparagraphs (D), (E), (F), (G), and (H), respectively; in subparagraph (D), as redesignated by clause (v), by inserting and highly rated after qualified ; in subparagraph (E), as redesignated by clause (v), by striking , Even Start, Early Reading First, and inserting , programs under part A of title IV, ; in subparagraph (F), as redesignated by clause (v), by striking section 1111(b)(3) and inserting section 1111(a)(2) ; and in subparagraph (G), as redesignated by clause (v), by striking proficient or advanced levels of academic achievement standards required by section 1111(b)(1) and inserting proficient and advanced levels of academic achievement standards described in section 1111(a)(1)(A)(iv) ; and in paragraph (2)— in subparagraph (A)— in the matter preceding clause (i), by striking No Child Left Behind Act of 2001), in consultation with the local educational agency and its school support team or other technical assistance provider under section 1117, and inserting ; and Strengthening America's Schools Act of 2013 ), in consultation with the local educational agency, in clause (iv), by striking section 1111(b)(3) and inserting section 1111(a)(2) ; and in subparagraph (B)— in clause (i)— in subclause (I), by striking , after considering the recommendation of the technical assistance providers under section 1117, ; and in subclause (II), by striking the No Child Left Behind Act of 2001 and inserting the ; Strengthening America's Schools Act of 2013 in clause (ii), by striking pupil services personnel and inserting specialized instructional support personnel ; and in clause (v), by striking Reading First, Early Reading First, Even Start, and inserting part A of title IV, ; and in subsection (c), by striking Even Start programs or Early Reading First programs and inserting programs under part A of title IV .
