Sec. 1224. Limitation on availability of funds for certain authorities for Afghanistan

Of the funds authorized to be appropriated by this Act or otherwise made available for fiscal year 2014 to carry out each of the provisions of law described in paragraph (2), not more than 50 percent may be obligated or expended until 15 days after the date on which the Secretary of Defense submits to the specified congressional committees the certification described in subsection (b). The provisions of law referred to in paragraph
(1)are the following: Section 1201 of the National Defense Authorization Act for Fiscal Year 2012 ( Public Law 112–81 ; 125 Stat. 1619; relating to the Commanders’ Emergency Response Program in Afghanistan). Section 1217 of the Ike Skelton National Defense Authorization Act for Fiscal Year 2011 ( Public Law 111–383 ; 124 Stat. 4393; relating to authority for program to develop and carry out infrastructure projects in Afghanistan). Section 1513 of the National Defense Authorization Act for Fiscal Year 2008 ( Public Law 110–181 ; 122 Stat. 428; relating to the Afghanistan Security Forces Fund). The certification referred to in subsection
(a)is a certification of the Secretary of Defense, in consultation with the Secretary of State, that the United States and Afghanistan have signed a bilateral security agreement that is in the national security interests of the United States. The Secretary of Defense may waive the applicability of the limitation in subsection (a)(1) if the Secretary determines that the waiver is in the national security interests of the United States. In this section, the term specified congressional committees means— the congressional defense committees; and the Committee on Foreign Relations of the Senate and the Committee on Foreign Affairs of the House of Representatives.
