Section 106 of the Rehabilitation Act of 1973 ( 29 U.S.C. 726(a) ) is amended— by striking subsection
(a)and inserting the following: The performance standards and indicators for the vocational rehabilitation program carried out under this title— shall be subject to paragraphs (2)(A) and
(3)of section 136(b) of the Workforce Investment Act of 1998; and may, at a State’s discretion, include additional indicators identified in the State plan submitted under section 101. ; and in subsection (b)(2)(B), by striking clause
(i)and inserting the following: on a biannual basis, review the program improvement efforts of the State and, if the State has not improved its performance to acceptable levels, as determined by the Director, direct the State to make revisions to the plan to improve performance; and .
