Section 145 ( 29 U.S.C. 2885 ) is amended— in subsection (a)— in paragraph (2)(C)(i) by striking vocational and inserting career and technical education and training ; and in paragraph (3)— by striking To the extent practicable, the and inserting The ; in subparagraph (A)— by striking applicable ; and by inserting and after the semicolon; by striking subparagraphs
(B)and (C); and by adding at the end the following: organizations that have a demonstrated record of effectiveness in placing at-risk youth into employment. ; in subsection (b)— in paragraph (1)— in subparagraph (B), by inserting and agrees to such rules after failure to observe the rules ; and by amending subparagraph
(C)to read as follows: the individual has passed a background check conducted in accordance with procedures established by the Secretary, which shall include— a search of the State criminal registry or repository in the State where the individual resides and each State where the individual previously resided; a search of State-based child abuse and neglect registries and databases in the State where the individual resides and each State where the individual previously resided; a search of the National Crime Information Center; a Federal Bureau of Investigation fingerprint check using the Integrated Automated Fingerprint Identification System; and a search of the National Sex Offender Registry established under the Adam Walsh Child Protection and Safety Act of 2006 (42 U.S.C. 16901 et seq.). ; and by adding at the end the following new paragraph: An individual shall be ineligible for enrollment if the individual— makes a false statement in connection with the criminal background check described in paragraph (1)(C); is registered or is required to be registered on a State sex offender registry or the National Sex Offender Registry established under the Adam Walsh Child Protection and Safety Act of 2006 ( 42 U.S.C. 16901 et seq. ); or has been convicted of a felony consisting of— homicide; child abuse or neglect; a crime against children, including child pornography; a crime involving rape or sexual assault; or physical assault, battery, or a drug-related offense, committed within the past 5 years. ; in subsection (c)— in paragraph (1)— by striking 2 years and inserting year ; and by striking an assignment and inserting a ; in paragraph (2)— in the matter preceding subparagraph (A), by striking , every 2 years, ; in subparagraph (B), by striking and at the end; and in subparagraph (C)— by inserting the education and training after including ; and by striking the period at the end and inserting ; and ; and by adding at the end the following: the performance of the Job Corps center relating to the indicators described in paragraphs
