Section 1834(a)(11)(B)(ii) of the Social Security Act ( 42 U.S.C. 1395m(a)(11)(B)(ii) ) is amended— by striking the physician documenting that ; and by striking has had a face-to-face encounter and inserting documenting such physician, physician assistant, practitioner, or specialist has had a face-to-face encounter . Notwithstanding any other provision of law, the Secretary of Health and Human Services may implement the amendments made by subsection
(a)by program instruction or otherwise.
