Any unexpended amounts available for obligation under the heading Federal Railroad Administration—Safety and Operations under the Consolidated Appropriations Act, 2005 ( Public Law 108–447 ) shall be made available for rail safety oversight activities for the transport of energy products: Provided , That $10,000,000 of unexpended amounts available for obligation under the heading Federal Railroad Administration—Capital Assistance to States—Intercity Passenger Rail Service for fiscal years 2008 and 2009 shall be made available for grade crossing safety improvements on rail routes that transport energy products.
