Sec. 101. White House Office of Mental Health Policy

There is established in the Executive Office of the President the White House Office of Mental Health Policy (hereafter referred to as the Office ), which shall— monitor Federal activities with respect to mental health, serious mental illness, and serious emotional disturbances; make recommendations to the Secretary of Health and Human Services regarding any appropriate changes to such activities, including recommendations with respect to the national strategy developed under paragraph (3); develop and annually update a National Strategy for Mental Health to maximize the access of individuals with mental illness to community-based services, strengthen the impact of such services, and meet the comprehensive needs of individuals with mental illness; make recommendations to the Secretary of Health and Human Services regarding public participation in decisions relating to mental health, serious mental illness, and serious emotional disturbances; review and make recommendations with respect to the budgets for Federal mental health services to ensure the adequacy of those budgets; submit to the Congress the national strategy and any updates to such strategy; coordinate the mental health services provided by Federal departments and agencies and coordinate Federal interagency mental health services; consult, coordinate with, facilitate joint efforts among, and support State, local, and tribal governments, nongovernmental entities, and individuals with a mental illness, particularly individuals with a serious mental illness and children and adolescents with a serious emotional disturbance, with respect to improving community-based and other mental health services; and develop and annually update a summary of advances in serious mental illness and serious emotional disturbances research related to causes, prevention, treatment, early screening, diagnosis or rule out, intervention, and access to services and supports for individuals with serious mental illness and children and adolescents with a serious emotional disturbance.
There shall be a Director who shall head the Office (hereafter referred to as the Director ) and who shall hold the same rank and status as the head of an executive department listed in section 101 of title 5, United States Code. The location of the Office in the Executive Office of the President shall not be construed as affecting access by Congress, or any committee of the House of Representatives or the Senate, to any— information, document, or study in the possession of, or conducted by or at the direction of, the Director; or personnel of the Office.
