Sec. 534. Consultation with victims of sexual assault regarding victims’ preference for prosecution of offense by court-martial or civilian court

Subsection
(b)of section 1044e of title 10, United States Code, is amended— by redesignating paragraphs (6), (7), (8), and
(9)as paragraphs (7), (8), (9), and (10), respectively; and by inserting after paragraph
(5)the following new paragraph (6): Legal consultation regarding the advantages and disadvantages of prosecution of the alleged sex-related offense by court-martial or by a civilian court with jurisdiction over the offense before the victim expresses a preference as to the prosecution authority pursuant to the process required by subsection (e)(3). . Subsection
(e)of such section is amended by adding at the end the following new paragraph: The Secretary concerned shall establish a process to ensure consultation with a victim of an alleged sex-related offense that occurs in the United States to discern the victim's preference regarding prosecution authority, regardless of whether the report of that offense is restricted or unrestricted. .
