Sec. 1611. Assessment and limitation on availability of funds for intelligence activities and programs of United States Special Operations Command and special operations forces

The Secretary of Defense, acting through the Under Secretary of Defense for Intelligence, the Assistant Secretary of Defense for Special Operations and Low Intensity Conflict, and the Director of the Defense Intelligence Agency, shall submit to the appropriate committees of Congress an assessment of the intelligence activities and programs of United States Special Operations Command and special operations forces. The assessment under paragraph
(1)shall include each of the following elements: An overall strategy defining such intelligence activities and programs, including definitions of intelligence activities and programs unique to special operations. A validated strategy and roadmap of intelligence, surveillance, and reconnaissance programs and requirements for special operations across the future years defense program. A comprehensive description of current and anticipated future Joint Staff validated requirements for the intelligence activities and programs of each geographic combatant commander within the respective geographic area of such covered combatant commander to be fulfilled by special operations forces, including those that can only be addressed by special operations forces, programs, or capabilities. Validated present and planned United States Special Operations Command force structure requirements to meet current and anticipated special operations intelligence activities and programs of geographic combatant commanders. A comprehensive review and assessment of statutory authorities, and Department and interagency policies, including limitations, for special operations forces intelligence activities and programs. An independent, comprehensive cost estimate of special operations intelligence activities and programs by the Director of Cost Assessment and Program Evaluation of the Department of Defense, including an estimate of the costs of the period of the current future years defense program, including a description of all rules and assumptions used to develop the cost estimates. A copy of any memoranda of understanding or memoranda of agreement between the Department of Defense and other departments or agencies of the United States Government, or between components of the Department of Defense that are required to implement objectives of special operations intelligence activities and programs. Any other matters the Secretary considers appropriate. The assessment required under paragraph
(1)shall be submitted in unclassified form, but may include a classified annex. Subject to paragraph (2), not more than 50 percent of the funds authorized to be appropriated by this Act or otherwise made available for fiscal year 2015 for procurement, Defense-wide, or research, development, test, and evaluation, Defense-wide, for the major force program 11 of the United States Special Operations Command may be obligated until the assessment required under subsection
(a)is submitted. Paragraph
(1)shall not apply with respect to funds authorized to be appropriated for Overseas Contingency Operations under title XV. In this section: The term appropriate committees of congress means the congressional defense committees, the Permanent Select Committee on Intelligence of the House of Representatives, and the Select Committee on Intelligence of the Senate. The term future years defense program means the future years defense program under section 221 of title 10, United States Code. The term geographic combatant commander means a commander of a combatant command (as defined in section 161(c) of title 10, United States Code) with a geographic area of responsibility.
