Sec. 2815. Special easement acquisition authority, Pacific Missile Range Facility, Barking Sands, Kauai, Hawaii

The Secretary of the Navy may use the authority provided by sections 2664 and 2684a of title 10, United States Code, to enter into agreements with or acquire from willing sellers easements and other interests in real property in the vicinity of the Pacific Missile Range Facility, Barking Sands, Kauai, Hawaii, for the purpose of— limiting encroachments on military training, testing, and operations at that installation; or facilitating such training, testing, and operations. As consideration for the acquisition of an easement or other interest in real property under subsection (a), the Secretary of the Navy may not pay an amount in excess of the fair market value of the interest to be acquired.
An easement or other interest in real property may be acquired under subsection
(a)only from a willing seller. Nothing in this section shall be construed to permit the Secretary of the Navy to use this section as authority to acquire all right, title, and interest in and to real property in the vicinity of the Pacific Missile Range Facility, Barking Sands. In this section, the term vicinity means the area within 30 miles of the boundaries of the Pacific Missile Range Facility, Barking Sands.
