Section 154 ( 20 U.S.C. 9544 ) is amended— in subsection (a)— by striking In carrying and inserting the following: In carrying ; and by adding at the end the following: For purposes of this section, the term eligible applicant means an applicant that has the ability and capacity to carry out activities under this part. An eligible applicant that wishes to receive a grant, or enter into a contract or cooperative agreement, under this section shall submit an application to the Statistics Commissioner at such time, in such manner, and containing such information as the Statistics Commissioner may require. An application submitted under subparagraph
(A)shall describe how the eligible applicant will address and demonstrate progress on the requirements of the performance management system described in section 185, with respect to the activities that will be carried out under the grant, contract, or cooperative agreement. ; in subsection (b)(2)(A), by striking vocational and and inserting career and technical education programs, ; and in subsection (c), by striking 5 years the second place it appears and inserting 2 years if the recipient demonstrates progress on the requirements of the performance management system described in section 185, with respect to the activities carried out under the grant, contract, or cooperative agreement received under this section .
