Section 113 ( 20 U.S.C. 9513 ) is amended— in subsection (a)— by striking paragraph (1); by redesignating paragraphs
(2)through
(5)as paragraphs
(1)through (4), respectively; and in paragraph (2), as so redesignated, by striking of the National Assessment of Educational Progress Authorization Act ; in subsection (b), by striking Secretary may assign the Institute responsibility for administering and inserting Director may accept requests from the Secretary for the Institute to administer ; and by adding at the end the following: With respect to any contract entered into under this title, the Director shall be consulted— during the procurement process; and in the management of such contract’s performance, which shall be consistent with the requirements of the performance management system described in section 185. .
