Section 80301 of title 46, United States Code, is amended by adding at the end the following: Payments received pursuant to subsection (b)(1) shall be credited to the appropriation for operating expenses of the Coast Guard. A Coast Guard vessel or aircraft may not be used to carry out an agreement under subsection
(a)in fiscal year 2015 and any fiscal year thereafter unless payments are received by the United States Government pursuant to subsection (b)(1) in the preceding fiscal year in a total amount that is not less than difference between— the cost incurred by the Coast Guard in maintaining the services; minus the amount of the proportionate share of the expense generated by vessels documented under the laws of the United States. Notwithstanding paragraph (1), Coast Guard aircraft may be used to carry out an agreement under subsection
(a)if the President determines it necessary in the interest of national security. The President shall notify the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate of a determination made under paragraph
(2)within 15 days after such determination. . Section 80302 of title 46, United States Code, and the item relating to such section in the analysis for chapter 803 of such title, are repealed on October 1, 2014.
