Chapter 5 of title 14, United States Code, as amended by this Act, is further amended by adding at the end the following: The Secretary may only make a determination that a waterway, or any portion thereof, is navigable for purposes of the jurisdiction of the Coast Guard through a rulemaking that is conducted in a manner consistent with subchapter II of chapter 5 of title 5. .
