Except as provided in subsection (b), the Act of August 28, 1937 ( 43 U.S.C. 1181a et seq. ) is repealed effective on October 1 of the first fiscal year beginning after the appointment of the Board of Trustees. If, as a result of judicial review authorized by section 312, any provision of this subtitle is held to be invalid and implementation of the provision or any activity conducted under the provision is then enjoined, the Act of August 28, 1937 ( 43 U.S.C. 1181a et seq. ), as in effect immediately before its repeal by subsection (a), shall be restored to full legal force and effect as if the repeal had not taken effect.
