The independent panel established by the Secretary of Defense under section 576(a)(2) of the National Defense Authorization Act for Fiscal Year 2013 ( Public Law 112–239 ; 126 Stat. 1758), known as the judicial proceedings panel , shall perform the following additional duties: Conduct a review and assessment regarding the impact of the use of any mental health records of the victim of an offense under chapter 47 of title 10, United States Code (the Uniform Code of Military Justice), by the accused during the preliminary hearing conducted under section 832 of such title (article 32 of the Uniform Code of Military Justice), and during court-martial proceedings, as compared to the use of similar records in civilian criminal legal proceedings.
Conduct a review and assessment regarding the establishment of a privilege under the Military Rules of Evidence against the disclosure of communications between— users of and personnel staffing the Department of Defense Safe Helpline; and users of and personnel staffing of the Department of Defense Safe HelpRoom. The judicial proceedings panel shall include the results of the reviews and assessments conducted under subsection
(a)in one of the reports required by section 576(c)(2)(B) of the National Defense Authorization Act for Fiscal Year 2013 ( Public Law 112–239 ; 126 Stat. 1760).
