Sec. 1049. Modifications to OH–58D Kiowa Warrior aircraft

Notwithstanding section 2244a of title 10, United States Code, the Secretary of the Army may modify OH–58D Kiowa Warrior aircraft of the Army that the Secretary determines will not be retired and will remain in the aircraft fleet of the Army. The Secretary shall carry out the modifications under subsection
(a)in a manner that ensures— the safety and survivability of the crews of the OH–58D Kiowa Warrior aircraft; the safety of flight for such aircraft; and that the minimum capability requirements of the commanders of the combatant commands are met.
