The approval to construct or operate a Priority Energy Project pursuant to any Federal permit, as applicable, shall remain valid and authorized for the later of— 18 months following the date on which the last permit needed by a Priority Energy Project to commence construction or operation is final and no longer subject to judicial review; 3 years; or in the case of a nationwide permit issued by the Army Corps of Engineers pursuant to part 330 of title 33, Code of Federal Regulations, 5 years.
