None of the funds appropriated by this Act under the headings Global Health Programs , Economic Support Fund , and International Narcotics Control and Law Enforcement shall be made available for assistance for a government of an Independent State of the former Soviet Union if that government directs any action in violation of the territorial integrity or national sovereignty of any other Independent State of the former Soviet Union, such as those violations included in the Helsinki Final Act: , That such funds may be made available without regard to the restriction in this subsection if the President determines that to do so is in the national security interest of the United States.
Provided Funds appropriated by this Act under the heading Economic Support Fund may be made available, notwithstanding any other provision of law, for assistance and related programs for the countries identified in section 3(c) of the Support for Eastern European Democracy
(SEED)Act of 1989 ( Public Law 101–179 ) and section 3 of the FREEDOM Support Act ( Public Law 102–511 ) and may be used to carry out the provisions of those Acts: , That such assistance and related programs from funds appropriated by this Act under the headings Provided Global Health Programs , Economic Support Fund , and International Narcotics Control and Law Enforcement shall be administered in accordance with the responsibilities of the coordinator designated pursuant to section 601 of the Support for Eastern European Democracy
(SEED)Act of 1989 ( Public Law 101–179 ) and section 102 of the FREEDOM Support Act ( Public Law 102–511 ). Section 907 of the FREEDOM Support Act shall not apply to— activities to support democracy or assistance under title V of the FREEDOM Support Act and section 1424 of Public Law 104–201 or non-proliferation assistance; any assistance provided by the Trade and Development Agency under section 661 of the Foreign Assistance Act of 1961 ( 22 U.S.C. 2421 ); any activity carried out by a member of the United States and Foreign Commercial Service while acting within his or her official capacity; any insurance, reinsurance, guarantee, or other assistance provided by the Overseas Private Investment Corporation under title IV of chapter 2 of part I of the Foreign Assistance Act of 1961 ( 22 U.S.C. 2191 et seq. ); any financing provided under the Export-Import Bank Act of 1945; or humanitarian assistance.
