Section 240A(a) is amended by inserting after paragraph
(3)the following: The Attorney General may waive the application of subparagraph
(C)to an individual only if the individual’s conviction resulted in a sentence served of two years or less and the Attorney General determines in his or her sole discretion that the individual does not pose a danger to the community or a national security threat and that subparagraph
(C)should be waived for compelling reasons such as to preserve family unity or because removal is otherwise not in the public interest. .
