The Secretary, in accordance with subsections
(b)and
(c)and with the concurrence of the Administrator of the Environmental Protection Agency, is authorized to reopen the Cape Arundel Disposal Site (in this section referred to as the Site ) as an alternative dredged material disposal site under section 103(b) of the Marine Protection, Research, and Sanctuaries Act of 1972 ( 33 U.S.C. 1413(b) ). The Site may remain open under subsection
(a)until the earlier of— the date on which the Site does not have any remaining disposal capacity; the date on which an environmental impact statement designating an alternative dredged material disposal site for southern Maine has been completed; or the date that is 5 years after the date of enactment of this Act. The use of the Site as a dredged material disposal site under subsection
(a)shall be subject to the conditions that— conditions at the Site remain suitable for the continued use of the Site as a dredged material disposal site; and the Site not be used for the disposal of more than 80,000 cubic yards from any single dredging project.
