Section 609(d) of title 5, United States Code, is amended— in paragraph (2), by striking at the end and ; in paragraph (3), by striking the period at the end and inserting ; and ; and by adding at the end the following new paragraph: the Centers for Medicare & Medicaid Services of the Department of Health and Human Services (solely with respect to its capacity to issue rules governing the Medicare part B fee schedule for clinical laboratory services). .
