Section 347 of the Department of the Interior and Related Agencies Appropriations Act, 1999 (as contained in section 101(e) of division A of Public Law 105–277 ; 16 U.S.C. 2104 note) is amended— in subsection (a), by striking 2013 and inserting 2018 ; and in subsection (c), by adding at the end the following new paragraphs: At the discretion of the Secretary of Agriculture, a contract entered into by the Forest Service under this section may be considered a contract for the sale of property under such terms as the Secretary may prescribe without regard to any other provision of law.
Not later than 90 days after the date of enactment of this paragraph, the Chief and the Director shall issue for use in all contracts and agreements under this section fire liability provisions that are in substantially the same form as the fire liability provisions contained in— integrated resource timber contracts, as described in the Forest Service contract numbered 2400–13, part H, section H.4; and timber sale contracts conducted pursuant to section 14 of the National Forest Management Act of 1976 ( 16 U.S.C. 472a ). .
