Subtitle B of the Department of Agriculture Reorganization Act of 1994 is amended by inserting after section 225 ( 7 U.S.C. 6931 ) the following new section: The Secretary is authorized to establish in the Department the position of Under Secretary of Agriculture for Foreign Agricultural Services. If the Secretary establishes the position of Under Secretary of Agriculture for Foreign Agricultural Services under subsection (a), the Under Secretary shall be appointed by the President, by and with the advice and consent of the Senate.
Upon establishment, the Secretary shall delegate to the Under Secretary of Agriculture for Foreign Agricultural Services those functions under the jurisdiction of the Department that are related to foreign agricultural services. The Under Secretary of Agriculture for Foreign Agricultural Services shall perform such other functions as may be required by law or prescribed by the Secretary. Any official who is serving as Under Secretary of Agriculture for Farm and Foreign Agricultural Services on the date of the enactment of this section and who was appointed by the President, by and with the advice and consent of the Senate, shall not be required to be reappointed under subsection
(b)or section 225(b) to the successor position authorized under subsection
(a)or section 225(a) if the Secretary establishes the position, and the official occupies the new position, with 180 days after the date of the enactment of this section (or such later date set by the Secretary if litigation delays rapid succession). . Section 225 of the Department of Agriculture Reorganization Act of 1994 ( 7 U.S.C. 6931 ) is amended— by striking Under Secretary of Agriculture for Farm and Foreign Agricultural Services each place it appears and inserting Under Secretary of Agriculture for Farm Services ; and in subsection (c)(1), by striking and foreign agricultural . Section 296(b) of the Department of Agriculture Reorganization Act of 1994 ( 7 U.S.C. 7014(b) ) is amended— in paragraph (6)(C), by striking or at the end; in paragraph (7), by striking the period at the end and inserting a semicolon; and by adding at the end the following new paragraph: the authority of the Secretary to establish in the Department the position of Under Secretary of Agriculture for Foreign Agricultural Services in accordance with section 225A; .
