Section 702(b)(2) of the Employee Retirement Income Security Act of 1974 ( 29 U.S.C. 1182(b)(2) ) is amended by adding after and below subparagraph
(B)the following: In applying subparagraph (B), a group health plan (or a health insurance issuer with respect to health insurance coverage) may vary premiums and cost-sharing by up to 50 percent of the value of the benefits under the plan (or coverage) based on participation (or lack of participation) in a standards-based wellness program. . Section 2702(b)(2) of the Public Health Service Act ( 42 U.S.C. 300gg–1(b)(2) ) is amended by adding after and below subparagraph

Section 9802(b)(2) of the Internal Revenue Code of 1986 is amended by adding after and below subparagraph
(B)the following: In applying subparagraph (B), a group health plan may vary premiums and cost-sharing by up to 50 percent of the value of the benefits under the plan based on participation (or lack of participation) in a standards-based wellness program. . The amendments made by subsection
(a)shall apply to plan years beginning more than 1 year after the date of the enactment of this Act.
