Section 401(k) (as amended by this Act) is amended by adding at the end the following new paragraph: A matching contribution or nonelective contribution described in paragraph (3)(D)(ii), subparagraph
(B)or
(C)of paragraph (12), or paragraph (13)(D) shall not fail to satisfy the definition under such paragraph merely because the contribution is funded in whole or in part by forfeitures. . The amendment made by subsection
(a)shall apply to forfeitures allocated in accordance with section 401(k)(14) of the Internal Revenue Code of 1986 (as amended by subsection (a)) before, on or after the date of enactment of this Act.
