Sec. 2811. Codification of policies and requirements regarding closure and realignment of United States military installations in foreign countries

Section 2687a of title 10, United States Code, is amended— by redesignating paragraphs
(1)and
(2)of subsection
(a)as subparagraphs
(A)and (B), respectively; by redesignating paragraphs (1), (2), and
(3)of subsection
(b)as subparagraphs (A), (B), and (C), respectively, and in subparagraph (A), as redesignated, by striking subsection (a)(2) and inserting paragraph (1)(B) ; by striking
(b)and inserting Report elements .—A report under subsection

(1); and by striking
(a)and inserting Annual status report .—
(b). Annual report on status of overseas closures and realignments and master plans .—(1) Subsection
(a)of section 2921 of the National Defense Authorization Act for Fiscal Year 1991 ( Public Law 101–510 ; 10 U.S.C. 2687 note)— is transferred to section 2687a of title 10, United States Code; and is inserted after the heading of such section as subsection (a). Subsections (c), (d), (f), and
(g)of such section 2921— are transferred to section 2687a of title 10, United States Code; are inserted at the end of such section in that order; and are redesignated as subsections (c), (d), (e), and
(f)of such section; respectively. Section 2687a of title 10, United States Code, is further amended by adding after subsection (f), as added and redesignated by paragraph (2), the following new subsection: In this section: The term fair market value of the improvements means the value of improvements determined by the Secretary of Defense on the basis of their highest use. The term improvements includes new construction of facilities and all additions, improvements, modifications, or renovations made to existing facilities or to real property, without regard to whether they were carried out with appropriated or nonappropriated funds. . Section 2687a of title 10, United States Code, is further amended— in subsection (c), as transferred and redesignated by subsection (b)(2)— in paragraph (1)— by striking ; Establishment of by striking the first sentence; and in the second sentence, by striking such account and inserting the Department of Defense Overseas Military Facility Investment Recovery Account ; and in paragraph (2)(B), by striking Armed Forces and inserting armed forces ; in subsection (d), as transferred and redesignated by subsection (b)(2)— in paragraph (1), by inserting ( after Public Law 100–526 ; 10 U.S.C. 2687 note) Realignment Act ; and in paragraph (2)— in subparagraph (A)(i), by striking section 2685 of title 10, United States Code and inserting section 2685 of this title ; and in paragraph (2), by striking Armed Forces both places it appears and inserting armed forces ; and in subsection (f), as transferred and redesignated by subsection (b)(2), by striking section 480 of title 10, United States Code in paragraph
(3)and inserting section 480 of this title 10 . Section 2921 of the National Defense Authorization Act for Fiscal Year 1991 ( Public Law 101–510 ; 10 U.S.C. 2687 note) is repealed. The repeal of such section shall not affect the Department of Defense Overseas Military Facility Investment Recovery Account established by subsection (c)(1) of such section, amounts in such account, or the continued use of such account as provided in section 2687a of title 10, United States Code, as amended by this section.
