Sec. 238. NATO and the phased, adaptive approach to missile defense in Europe

Not later than 60 days after the date of the enactment of this Act, the President shall consult with the North Atlantic Council and the Secretary General of the North Atlantic Treaty Organization (in this section referred to as NATO ) on— the funding of the phased, adaptive approach to missile defense in Europe; and establishing a plan for NATO to provide at least 50 percent of the infrastructure and operations and maintenance costs of phase I of the phased, adaptive approach to missile defense in Europe.
The President shall use the NATO Military Common-Funded Resources process to seek to fund at least 50 percent of the costs for phases II and III of the phased, adaptive approach to missile defense in Europe. Not later than 180 days after the date of the enactment of this Act, and each 180-day period thereafter, the President shall submit to the congressional defense committees, the Committee on Foreign Affairs of the House of Representatives, and the Committee on Foreign Relations of the Senate a report on the funding provided by NATO pursuant to paragraphs
(1)and (2). If the Secretary of Defense determines that it is useful to the interests of the United States, the Secretary shall seek to engage with members of NATO to establish a NATO common pool of Aegis standard missile–3 block IA, standard missile–3 block IB, and standard missile–3 block IIA interceptors to defend NATO members through the phased, adaptive approach to missile defense in Europe.
