Sec. 4319. Restriction on sale of defense articles and defense services that would adversely affect United States combat readiness

The President may not sell defense articles and defense services if the sale of such articles or services would have significant adverse effect on the combat readiness of the United States Armed Forces. The President may waive the restriction in subsection
(a)if the President determines that the possible significant adverse effect on the combat readiness of the United States Armed Forces is outweighed by the benefits to United States national security and transmits such determination to the appropriate congressional committees and to the Committees on Armed Services of the House of the Representatives and the Senate. Each such determination shall be accompanied with a statement that shall include the following information: The country or international organization to which the sale is proposed to be made. The amount of the proposed sale. A description of the defense article or service proposed to be sold. A full description of the impact which the proposed sale will have on the United States Armed Forces. A justification for such proposed sale, including an explanation as to why, in the President’s judgment, benefits to United States national security from the sale outweighs the adverse impact on the readiness of the United States Armed Forces.
