There is established a Human Rights and Democracy Fund (in this section referred to as the Fund ) to be administered by the Assistant Secretary of State for Democracy, Human Rights, and Labor. The purpose of the Fund is to protect and promote fundamental freedoms and internationally recognized human rights by— supporting defenders of human rights and advocates of democracy; assisting victims of human rights violations; preventing and responding to violence against women and girls, in accordance with subtitle A; carrying out child protection compacts in accordance with section 3402; and responding to emergencies and unanticipated opportunities in the areas of human rights and democracy.
In administering the Fund, the Assistant Secretary of State for Democracy, Human Rights, and Labor shall consult with the Ambassador-at-Large for Global Women’s Issues and the Assistant Administrator for Democratic and Civic Development of the United States Agency for International Development. Funds made available under this section for a fiscal year are in addition to funds otherwise available for such purposes. Funds made available under this section for a fiscal year are authorized to be made available notwithstanding any provision of law that restricts assistance to a foreign country.
