48-2665. Plan for construction of works; notice; bids; award of contract; bond

A. The board of directors shall adopt a plan for the construction of the works authorized by section 48-2664.
B. The board shall give notice by publication thereof for not less than fifteen days in a newspaper published in each of the counties in which lands within the district are located, and in such other newspapers as the board deems advisable, calling for bids for the construction of the works contemplated in such plan, or any portion thereof. If less than the whole work is advertised then the portion so advertised shall be particularly described in the notice. The notice shall set forth that plans and specifications can be seen at the office of the board, that the board will receive bids for such work, and that the contract will be let to the lowest responsible bidder and shall state the time and place for opening bids.
Any person to whom a contract is awarded shall provide such bond or bonds as required under the provisions of title 34, chapter 2, article 2.
C. The bids shall be opened in public at the time and place specified in the notice. As soon as convenient thereafter the board shall let the work in portions, or in whole, to the lowest responsible bidder, or it may reject any and all bids and readvertise for bids, or may proceed to construct the works under supervision of the board.
D. Contracts for the purchase of materials shall be awarded to the lowest responsible bidder. Any person or persons to whom a contract is awarded shall provide a performance bond as required under provisions of title 34, chapter 2, article 2. The work shall be performed under the direction and to the satisfaction of the engineer and shall be approved by the board of directors.
