44-1862. Consent to service of process; service on commission

A. If consent to service of process is required under this chapter, such consent shall be in the form prescribed by the commission, shall be irrevocable and shall provide that actions arising out of or involving the sale or purchase of any securities in violation of this chapter may be commenced in any court of competent jurisdiction and proper venue within this state against the person executing the consent by the service of process or pleadings on the commission. The consent to service of process shall appoint the commission.
B. Service of the process or pleading in such action against a person who has filed a consent to service with the commission shall be made by service of duplicate copies, one of which shall be filed in the office of the director and the other immediately forwarded by the director by certified mail to the person against whom the process or pleading is directed at his latest address on file in the office of the director.
