28-5628. Refusal to issue license

If an application for a license to transact business as a supplier in this state is filed by a person whose license has previously been cancelled for cause by the director or if the director is of the opinion that the application is not filed in good faith or that the application is filed by some person as a subterfuge for a real person in interest whose license or registration has previously been cancelled for cause by the director and after a hearing, the director may refuse to issue a license to transact business as a supplier in this state.
The director shall give the applicant five days' notice in writing of the hearing. The applicant may appear in person or by counsel and present testimony.
