Unless the offense with which the person is charged is an offense that is punishable by death or life imprisonment under the laws of the state in which it was committed, or the person is alleged to have escaped from jail or prison or violated the terms of release following conviction of a crime that is punishable in the state of conviction by imprisonment for a term exceeding one year, a judge or magistrate in this state shall admit the person arrested to bail by bond or undertaking, with sufficient sureties, and in such sum as the court deems proper, conditioned on the person's appearance before the court at all times specified by the court, and for the person's surrender, upon the warrant of the governor of this state.
This section does not prevent the immediate service of the governor's warrant that is issued pursuant to section 13-3847.
