Sec. 26.05.913. Public records offenses.
A member of the militia who
(1)wilfully and unlawfully alters, conceals, removes, mutilates, obliterates, or destroys a public record or
(2)takes a public record with the intent to alter, conceal, remove, mutilate, obliterate, or destroy the public record may be punished by up to five years of confinement, by separation with characterization up to dishonorable discharge, and by such other punishment as a court-martial may direct.
