Sec. 26.05.735. Absence without leave.
A member of the militia who, without authority,
(1)fails to go to the member's appointed place of duty at the time prescribed,
(2)goes from the member's place of duty, or
(3)is absent or remains absent from the member's unit, organization, or place of duty at which the member is required to be at the time prescribed may be punished by up to one year of confinement, by separation with characterization up to dishonorable discharge, and by such other punishment as a court-martial may direct.
