58-92-302. General qualifications for licensure.
An applicant for licensure for a private investigator license, private investigator registrant, or private investigator apprentice under this chapter:
(1)shall:
(a)except for an applicant for a private investigator apprentice license, be at least 21 years old;
(b)be a citizen or legal resident of the United States;
(c)provide the applicant's name, address, date of birth, social security number, and fingerprints to the division;
(d)disclose any criminal history the division requests on a form the division approves;
(e)consent to, and complete, a criminal background check, described in Section 58-1-301.5 ;
(f)meet any other standard related to the criminal background check described in Section 58-1-301.5 , that the division establishes by rule in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act; and
(g)if currently licensed in another state or jurisdiction, be in good standing within that state or jurisdiction; and
(2)may not:
(a)have been convicted of:
(i)a felony;
(ii)any act involving illegally using, carrying, or possessing a dangerous weapon;
(iii)an act of personal violence or force on another person;
(iv)threatening to commit an act of personal violence or force against another person;
(v)an act constituting dishonesty or fraud;
(vi)impersonating a peace officer; or
(vii)an act that, when considered with the functions and duties imposed by this title, bears a substantial relationship to the individual's ability to safely or competently perform the duties required under this chapter or indicates that the best interests of the public are not served by granting the applicant a license;
(b)be on probation, parole, community supervision, or named in an outstanding arrest warrant; or
(c)have been previously found or presently be in violation of this chapter.
