58-92-201. Division to administer -- Division to issue licenses -- Records -- Bonds -- Rulemaking.
(1)On or after May 6, 2026, the division shall administer this chapter.
(a)The division shall issue a license to an applicant who meets the qualifications for licensure under this chapter.
(b)The division shall notify each licensee under this chapter when a licensee's license is due for renewal in accordance with procedures the division establishes by rule.
(a)The division shall keep records of:
(i)all applications for licenses under this chapter; and
(ii)all bonds and proof of certificates of liability and workers' compensation insurance required to be filed.
(b)The division shall include in the record described in Subsection (3)(a) statements as to whether the division has issued a license or renewal license for each application.
(4)If the division revokes, suspends, or denies a license, the division shall include the date of filing the order for revocation, suspension, or denial in the records.
(5)The division shall maintain:
(a)a list of all licensees whose license the division revokes, suspends, or denies;
(b)a written record of complaints filed against licensees; and
(c)records of board actions.
(6)In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act , the division may make rules governing the administration of the provisions of this chapter.
