41-1a-1611. Design review board -- Creation -- Duties.
(1)As used in this section, "board" means the Design Review Board created in Subsection
(2).
(2)There is created the Design Review Board.
(3)The board consists of the following members:
(a)one member appointed by the governor;
(b)one member appointed by the speaker of the House of Representatives; and
(c)one member appointed by the president of the Senate.
(4)The member of the board appointed by the governor shall serve as chair of the board.
(a)If all three members of the board are not present, the board may not consider or vote on a proposed license plate design.
(b)The board is not subject to Title 52, Chapter 4, Open and Public Meetings Act.
(a)The board shall:
(i)review each proposed license plate design;
(ii)vote whether to approve or reject the proposed license plate design;
(iii)consider a proposed license plate design for:
(A)a standard license plate as described in Subsection 41-1a-402(4) ; and
(B)a special group license plate;
(iv)determine which standard license plate designs the division may offer each year as described in Section 41-1a-402 ; and
(v)review and approve the design and format of:
(A)driver license certificates, as described in Subsection 53-3-207(3) ; and
(B)identification cards, as described in Subsection 53-3-805(3) .
(b)The design review board may not approve a license plate design if the license plate design does not comply with the standards described in Subsection
(8).
(7)If the board approves a proposed license plate design, the division may begin the processes necessary for production and distribution of the license plate.
(a)In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, in consultation with the design review board, the commission may make rules to establish:
(i)standards for license plate design that ensure color contrast ratios for a license plate are sufficient for readability as described in Section 41-1a-403 ; and
(ii)the uniform design standard and format for a special group license plate.
(b)Except for the following license plates, a special group license plate shall comply with the uniform design standards and format described in rules made under Subsection (8)(a) :
(i)a historical support special group license plate described in Subsection 41-1a-419(1)(c)(ii) ; and
(ii)a classic support special group license plate described in Subsection 41-1a-419(1)(c)(iii) .
