23A-5-310. Taking protected wildlife while trespassing -- Criminal penalty.
(1)A person may not take or permit the person's dog to take, while in violation of Subsection 23A-5-317(2) :
(a)protected wildlife or protected wildlife parts;
(b)an occupied nest of protected wildlife; or
(c)an egg of protected wildlife.
(2)A person who violates Subsection
(1)is subject to the penalty provided in Section 23A-5-301 .
