17B-1-119. Duty to comply with local land use provisions -- Requirements before providing a service.
(a)If a land use authority consults with or allows a special district to participate in any way in a land use authority's land use development review or approval process, the special district shall comply with Title 10, Chapter 20 , Municipal Land Use, Development, and Management Act, or Title 17, Chapter 79 , County Land Use, Development, and Management Act, as applicable to the land use authority.
(b)The compliance required under Subsection
(a)is not limited to the special district's participation in the land use authority's review or approval process.
(a)Before a special district begins providing a service to a service applicant, the service applicant shall provide the special district with an improvement assurance and an improvement assurance warranty.
(b)A special district that has not received an improvement assurance and an improvement assurance warranty from a service applicant may not begin providing service to the service applicant.
