Hubbard.Summoned before Army retiring board to inquire as to nature, etc., of disabilities. That the President of the United States be, and he is hereby, authorized to summon Edmund F. Hubbard, late captain of Infantry of the Regular Army of the United States, before a retiring board for the purpose of a hearing of his case and conducting such physical examinations as to the said board may seem proper and to inquire into and determine all the facts touching on the nature of his disabilities and to find and report the disabilities which in its judgment has produced his incapacity and whether his disabilities are an incident of service; that Order of discharge may be confirmed, or appointment as captain of Infantry, retired, authorized.upon the findings of such a board the President is further authorized, in his discretion, either to confirm the order by which the said Edmund F.
Hubbard was discharged or, in his discretion, to nominate and appoint, by and with the advice and consent of the Senate, the said Edmund F. Hubbard a captain of Infantry and place him immediately thereafter upon the retired list of the Army, with the same privileges and retired pay as are now or may hereafter be provided by law or regulation for the officers of the Regular Army: *Proviso*.No back pay.*Provided*, That the said Edmund F. Hubbard shall not be entitled to any back pay or allowances by the passage of this Act.
