BILLING CODE 4910-13-P DEPARTMENT OF TRANSPORTATION Federal Railroad Administration [Docket Number FRA-2003-15638] Petition for Waiver of Compliance Under part 211 of Title 49 Code of Federal Regulations (CFR), this document provides the public notice that on May 8, 2019, the Long Island Rail Road petitioned the Federal Railroad Administration
(FRA)for an extension of an existing waiver of compliance from certain provisions of the Federal railroad safety regulations contained at 49 CFR part 238, *Passenger Car Safety Standards* . FRA assigned the petition Docket Number FRA-2003-15638. Specifically, LIRR requests to extend the waiver from § 238.303(e)(l5)(i)(c), for its fleet of M7 multiple unit
(MU)locomotives. The provision requires that MU type locomotives equipped with dynamic brakes that become defective “shall be repaired or removed from service by or at the locomotive's next exterior calendar day mechanical inspection.” LIRR states “in the 15 years that this waiver has been in place, the LIRR has not encountered either reports of slow trains or handling complaints related to inactive trucks.” LIRR contends the waiver provides “operational flexibility without any compromise in safety or performance.” LIRR explains it removes “inactive trucks from service within three calendar days when practical.” A copy of the petition, as well as any written communications concerning the petition, is available for review online at *www.regulations.gov* and in person at the U.S. Department of Transportation's

FRA does not anticipate scheduling a public hearing in connection with these proceedings since the facts do not appear to warrant a hearing. If any interested parties desire an opportunity for oral comment and a public hearing, they should notify FRA, in writing, before the end of the comment period and specify the basis for their request.
