§ 3219.1. Well control emergency response.
(a)Contracts.-- The department may enter into contracts with well control specialists in order to provide adequate emergency response services in the event of a well control emergency. The department shall make available, upon request by a county, information relating to contracts with well control specialists.
(b)Civil immunity.-- Except as set forth in subsection (c), a well control specialist with which the department has entered into a contract under subsection
(a)shall be immune from civil liability for actions taken in good faith to carry out its contractual obligations.
(c)Nonapplicability.-- Subsection
(b)shall not apply to damage arising from any of the following:
(1)Breach of the contract under subsection (a).
(2)An intentional tort.
(3)Gross negligence.
