§85A-33. Statute of limitations.

A. The right to claim compensation for benefits from the Multiple Injury Trust Fund shall be forever barred unless a Notice of Claim, on a form prescribed by the Workers' Compensation Commission, shall be filed with the Commission within one
(1)year
of the date of the last order for permanent partial disability arising from the latest claim against the last employer.
B. When a claim for benefits from the Multiple Injury Trust Fund is filed, unless a claimant shall in good faith request a hearing and final determination thereon within two
(2)years of the filing thereof, the same shall be barred.
C. An attorney who represents a respondent or insurance carrier in a claim against the last employer shall not represent the employee in a subsequent claim against the Multiple Injury Trust Fund.
