Sec. 5-152.1. Parent's annuity.
(a)A parent's annuity shall be provided for the natural parent or parents of a policeman who dies on or after the effective date of this amendatory Act of 1996 while
(i)in active service,
(ii)disabled and in receipt of or pending receipt of a disability benefit,
(iii)on leave of absence with whole or part pay,
(iv)on leave of absence without pay during a period of not more than 3 months in the aggregate,
(v)in receipt of annuity granted after 20 years of service, or
(vi)out of the service after 20 years of service and pending receipt of annuity to which the policeman has a right upon attainment of age 50 or more. However, the parent's annuity is payable only if there is no surviving spouse or child entitled to an annuity as a result of the policeman's death, and satisfactory proof is submitted to the board that the policeman was contributing to the support of the parent or parents at the time of death.
(b)Beginning July 1, 1997, a parent's annuity shall be available to the natural parent or parents of a policeman who died before August 9, 1996 while
(i)in active service,
(ii)disabled and in receipt of or pending receipt of a disability benefit,
(iii)on leave of absence with whole or part pay,
(iv)on leave of absence without pay during a period of not more than 3 months in the aggregate,
(v)in receipt of annuity granted after 20 years of service, or
(vi)out of the service after 20 years of service and pending receipt of annuity to which the policeman has a right upon attainment of age 50 or more. However, the parent's annuity is payable only if there is no surviving spouse or child entitled to an annuity as a result of the policeman's death, and satisfactory proof is submitted to the board that the policeman was contributing to the support of the parent or parents at the time of death. The parent's annuity shall begin no earlier than the first day of the month following the month in which the application for parent's annuity is received by the Fund.
(c)The parent's annuity shall be 18% of the current annual salary attached to the classified position held by the policeman at the time of death or withdrawal from service for each eligible surviving parent, payable on a monthly basis.
