Sec. 205-65. Municipal Urban Agricultural Areas. The Department shall adopt rules consistent with the purposes of Division 15.4 of the Illinois Municipal Code. The Department shall adopt, at a minimum, rules defining "small or medium sized farmer", "beginning farmer", "limited resource farmer", and "socially-disadvantaged farmer" as used in Section 11-15.4-5 of the Illinois Municipal Code and shall consider definitions of these terms set forth in the Agricultural Act of 2014 or the most recent federal Agricultural Act and the use of those terms by the United States Department of Agriculture.
Upon request from a municipality, the Department shall issue opinions regarding the consistency of applicants covered under these definitions.
