A fine or monetary penalty specified in Section 39674; subdivision (a), (b), (d), or
(e)of Section 42400; Section 42402; or subdivision
(a)of Section 44381 of this code, that may be imposed as the result of conduct that is also subject to Chapter 5 (commencing with Section 17200) of Part 2 of Division 7 of the Business and Professions Code, may be collected either under those provisions of this code, or under that chapter of the Business and Professions Code, but not under both.
