The Sports Broadcasting Act of 1961 is amended by inserting after section 6 (as added by section 905 of this Act) the following: A broadcast network, streaming platform, or other distributor to which any streaming or digital distribution rights to college athletic competitions in sports other than football or basketball are sold, licensed, or otherwise conveyed by a participating association or its member institutions shall affirmatively use those rights by making the competitions reasonably available to the public not later than 1 year after the effective date of the agreement under which the rights are sold, licensed, or otherwise conveyed.
If a broadcast network, streaming platform, or other distributor to which streaming or digital distribution rights are sold, licensed, or otherwise conveyed as described in subsection
(a)does not use, or materially underutilizes, the rights during the 1-year period beginning on the effective date of the agreement under which the rights are sold, licensed, or otherwise conveyed, the rights shall automatically revert to the originating association or institution. Upon the reversion of rights under paragraph (1), the originating association or institution may resell, relicense, or otherwise reconvey the rights to another entity without penalty or liability for breach of the original agreement described in that paragraph. .
