Section 1009 of the Federal Food, Drug, and Cosmetic Act ( 21 U.S.C. 399 ) is amended— in subsection (d)(1), by striking 3 years and inserting 5 years ; and in subsection (e)— by striking 3 years and inserting 5 years ; and by amending the second sentence to read as follows: In the event the Secretary conducts a program evaluation, funding in subsequent years of the grant, where applicable, shall be contingent on a successful program evaluation by the Secretary after the first year of the grant. . The amendments made by subsection
(a)apply only with respect to grants awarded under section 1009 of the Federal Food, Drug, and Cosmetic Act ( 21 U.S.C. 399 ) on or after the date of the enactment of this Act.
